Canadian judge adds Monsanto's court costs to ruling against Schmeiser

(April 30, 2002 – CropChoice news) -- Those who thought that the first phase of the legal battle facing Canadian farmer Percy Schmeiser was over should think again. Federal Court of Canada Judge Andrew MacKay has ordered Schmeiser to pay Monsanto’s court costs of C$153,000. He ruled last year that the farmer infringed the patent on Monsanto’s Roundup-resistant canola and that the profit from his 1998 canola crop, which was contaminated with Monsanto’s gene for herbicide resistance, should go to the company.

The judge said that Schmeiser should have known that the seed he saved from his 1997 and planted on 1,000 acres in 1998 contained Monsanto’s patented gene.

Appeals court justices will hear Schmeiser’s challenge to the lower court ruling on May 15 and 16.
