Wheat farm sues over checkoff (Monday, Oct. 27, 2003 -- CropChoice news) -- Associated Press, 10/24/03: Little Rock - A farm in Arkansas has filed a lawsuit over a state program that promotes wheat products.
The suit was filed by J&W Farms Partnership. It claims the money collected by the state Wheat Promotion Board is an illegal tax. The suit also claims it infringes on farmers' free-speech rights when it's used for generic wheat advertising.
The suit was filed this week in Pulaski County Circuit Court. It seeks a refund of all money collected by the board since the wheat checkoff program began in the state in 1985. It's unclear how much that would be, though the board collected nearly $290,000 last year alone.
The Wheat Promotion Board responds that in Arkansas, farmers can ask for a refund within 45 days of payment.
